Welcome to GameHeroWorld.com! These terms and conditions, which include and hereby incorporate the Rewards Program and Privacy Policy (collectively referred to as the "Terms of Service"), constitute a binding legal agreement between you and GameHeroWorld.com, its subsidiaries, and affiliated companies ("GameHeroWorld.com"). These Terms of Service govern your use of (i) the website located at www.GameHeroWorld.com (the "Site"), including any services, features, and content accessible or downloadable from the Site, and (ii) any other GameHeroWorld.com application, service, or product licensed, downloaded, or otherwise accessed by you through third-party websites or sources (collectively referred to as the "Service"). Please note that the Service is not intended for use by individuals under 14 years of age.

By accessing or using our Services or by downloading or posting any content on or through our Services, you are indicating that you have read, understand, and agree to be bound by these Terms of Service. If you do not agree to these terms, you should not access or use our Services or content.

Definitions

• System: Refers to the server design and action code that controls the overall store.
• Site: Shorthand for the GameHeroWorld website.
• Account: Your member account registered with the System.
• Member: A user who has a member account with the Site.

1. Sign Up Consent & Account Registration

This consent falls under the category of "Legitimate Interest," where processing an individual's personal data is strictly necessary for business purposes, such as fulfilling product licensing or preventing fraud.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify GameHero immediately of any unauthorized use of your account or any other breach of security.

2. Access to the Services

Subject to the terms and conditions of this Agreement, GameHeroWorld.com may offer to provide the Services described more fully on the Site, solely for your own use and not for the use or benefit of any third party. Services include any services GameHeroWorld.com performs for you, as well as the offering of any materials displayed or performed on the Site (referred to as the "Content"). GameHeroWorld.com reserves the right to change, suspend, or discontinue the Services or any Content for any reason, at any time, without notice or liability.

You certify to GameHeroWorld.com that if you are an individual (not a corporation), you are at least 13 years of age, and you are legally permitted to use the Services and access the Site. GameHeroWorld.com will use reasonable efforts to ensure that the Site and Services are available 24/7, but there may be occasional interruptions for maintenance, upgrades, or other reasons beyond GameHeroWorld.com's control.

3. Site Content

You may download or copy the Content and other items displayed on the Site for personal use only, provided that you maintain all copyright and other notices contained in such Content. You may not store any significant portion of any Content. Copying or storing Content for other than personal, noncommercial use is expressly prohibited without prior written permission from GameHeroWorld.com. All trademarks, service marks, and trade names appearing on the Site are proprietary to GameHeroWorld.com and/or third parties.

By contributing User Content to the Site, you grant GameHeroWorld.com a non-exclusive, worldwide, royalty-free right to fully exploit such User Content, including all related intellectual property rights. GameHeroWorld.com reserves the right to remove any User Content from the Site at any time for any reason.

4. Restrictions

You are responsible for all activity in connection with the Services and accessing the Site. You may not post or transmit any communication or solicitation designed to obtain password, account, or private information from any GameHeroWorld.com user. You shall not engage in any illegal activity or violate the security of any computer network.

5. Warranty Disclaimer

The Services, Content, Site, and any software are provided "as is" without warranties of any kind, either express or implied. GameHeroWorld.com disclaims any liability for the accuracy, legality, or decency of material contained on the Site.

6. Third Party Websites

GameHeroWorld.com may provide links to third-party sites on the Internet, but it does not endorse the products or services offered on such sites. GameHeroWorld.com disclaims any liability for third-party content or services.

7. Registration and Security

You may be required to register with GameHeroWorld.com to use certain Services and select a password and username. You shall provide accurate, complete, and updated registration information and maintain the confidentiality of your password.

8. Indemnity

You will indemnify and hold GameHeroWorld.com, its directors, officers, and employees harmless from any claim or demand arising out of your access to the Site, use of the Services, or violation of this Agreement.

9. Limitation of Liability

In no event shall GameHeroWorld.com or its directors, officers, or employees be liable for any damages arising out of the Site or Services.

10. Virtual Currency and Goods

The Service may include virtual currency and virtual goods subject to GameHeroWorld.com's terms and conditions.

11. Termination

Either party may terminate the Services at any time. GameHeroWorld.com may also terminate or suspend Services and access to the Site immediately for breach of this Agreement.

12. Acts of Fraud

Gameheroworld.com has a zero tolerance policy against acts of fraud. Any act of fraud against Gameheroworld.com will result in Account termination and forfeit of orders and licenses.

Such acts of fraud include but are not limited to:

• Using payment instruments that belong to another person who has not given permission for use.
• Attempting to gain access to any other Shopper Account to place purchases without the owner's consent.
• Filing disputes with 3rd party payment institutions without first contacting and conversing with Store Support to resolve any issue (including time for Store Support to respond and help resolve problems).
• Filing false claims against the store without grounds to support such claims.
• Misrepresentation of self, for the purpose of thwarting systems in place not limited to regional pricing or locks, is also grounds for account termination.

13. Privacy

15. Modification

GameHeroWorld.com reserves the right to modify, discontinue, or terminate the Services or these Terms of Service at any time without prior notice.

16. Miscellaneous

The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. GameHeroWorld.com shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond WINGAMESTORE.COM's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sublicensable by you except with GameHeroWorld.com’s prior written consent. GameHeroWorld.com  may transfer, assign or delegate this Agreement and its rights and obligations without consent. This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta without regard to the conflict of laws provisions thereof. Both parties agree that this Agreement (including the Privacy Policy) is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement. No agency, partnership, joint venture, or employment is created as a result of this Agreement and you do not have any authority of any kind to bind GameHeroWorld.com in any respect whatsoever.

17. Purchases

By making a purchase through the Site, you agree to pay the specified price for the products or services ordered, including any applicable taxes and fees.

All sales are final. GameHero does not offer refunds or exchanges for game keys, once they have been delivered and are outside of the protection of the Refun Policy.

GameHero reserves the right to cancel or refuse any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraud.

18. Changes to Terms of Service

GameHero reserves the right to update or modify these Terms of Service at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site and Services after any such changes constitutes your acceptance of the revised Terms of Service.
